Overview

Paula M. Castaldo, Esq. is a Vice President, Corporate Counsel in Prudential Financial’s in-house Law Department, specializing in employment and labor law.  In this role, she supports Prudential’s Group Insurance and Enabling Solutions businesses, and many of its corporate centers, including Corporate Human Resources, and the Risk, CIO, Audit, Finance, Actuarial, Marketing, and Communications organizations.  She provides counseling and training to these clients regarding: compliance with all federal and state employment and labor laws including laws relating to workplace discrimination, harassment, and retaliation, wage and hour laws, the National Labor Relations Act, the Americans with Disabilities Act, family and medical leave laws, laws applicable to federal contractors, and laws relating to restrictive covenants; and best practices relating to workplace reorganizations, diversity and inclusion initiatives, and contingent workforce management.

Immediately prior to joining Prudential in 2012, Ms. Castaldo was a partner in the Labor and Employment practice group of a large New Jersey-headquartered law firm.  In private practice, she defended employers in litigation actions involving alleged violations of federal and state employment and labor laws.  In addition, she represented employers before administrative agencies, participated in handling grievance arbitrations and arbitrations before the National Association of Securities Dealers, provided counseling to management regarding personnel issues and union relations, and conducted numerous workplace investigations as a third-party investigator.  The clients she represented while in private practice included various pharmaceutical companies, major retailers and manufacturers, financial institutions, and institutions of higher education.

Ms. Castaldo earned a J.D. from Harvard Law School, a B.A (Psychology) from the University of Pennsylvania’s College of Arts and Sciences, and a B.S. (Economics) degree from The Wharton School.

    This course is based on the principle that knowledge and understanding of employment law facilitate (1) promotion of a workforce with a high degree of commitment to reaching business goals, (2) the development of practical business solutions to problems arising in the workplace, (3) effective human resources policy and procedures that comply with applicable laws, and (4) justice for workers. The course provides students with an introduction to the law of the workforce and examines the balance between business goals and employment law compliance. The course examines the various employment laws with which businesses must comply and the legal rights and responsibilities of employees and employers. The emphasis is on laws concerning equal employment opportunity with respect to discrimination and harassment because of sex, race, national origin, religion, sexual orientation, age, disability and other characteristics protected by workforce laws; constitutional -- and especially free speech -- rights at work; work-related privacy including investigations, electronic communication and social media; classifying workers in the gig economy; diversity and affirmative action; and the legal and regulatory environment regarding immigration, wage and hour, leaves of absence, hiring, termination and afterwards; and labor/management relations and collective bargaining.
